
Terms and Conditions (GTC)
scope
These terms and conditions apply to the generally binding accommodation contract for the rental of accommodation (rooms, holiday apartments, hereinafter referred to as “accommodation”) as well as all other services offered between the Pension Remise Heiligener See - Bärbel Freund-Descher, Mangerstr. 11, 14467 Potsdam, Germany, Tel.: +49 (0)171 88 50 000 (hereinafter referred to as “Pension”) and its guests (hereinafter referred to as “Guest”). A unilateral change in the use of the services offered is not permitted or requires written consent.
Conclusion of contract
1. If accommodation is ordered and confirmed or provided for short-term bookings, an accommodation contract has been concluded. A legally binding contract also exists for verbal, especially telephone bookings, unless expressly agreed in writing.
2. The conclusion of the accommodation contract obliges both contractual partners to fulfill the contract, regardless of the duration for which the contract is concluded. The guesthouse is obliged to provide the booked accommodation for the agreed period. The guest must pay the accommodation price as contractually agreed. 50% of the fee for accommodation and all services provided by the guest is due immediately after booking confirmation (to be paid by bank transfer to the account specified in the booking confirmation) and the remaining amount is due for payment on the day of arrival and is generally payable in cash or by card payment (Giro/Visa/Master).
3. The prices quoted by the guesthouse are final prices and include VAT and all additional costs, unless otherwise stated. Additional surcharges and fees may apply for services that are billed based on consumption (electricity, water, gas, firewood, etc.) and, if necessary, for optional and additional services.
4. The guest undertakes to comply with the house rules.
Handover and return of the accommodation
The booked accommodation is available to the guest from 3 p.m. on the agreed arrival day.
On the agreed departure day, the accommodation must be vacated by 11 a.m. at the latest. Different agreements can be made between the guesthouse and the guest.
resignation
1. A unilateral, free withdrawal by the guest from a binding booking is generally excluded if the guest cannot use the booked accommodation for reasons that lie within his sphere of risk (exception: force majeure).
2. If the guest nevertheless withdraws from the contract, the following cancellation fees will be charged by the guesthouse:
from 4 weeks before the start of the contract 10% of the agreed price;
from 2 weeks before the start of the contract 50% of the agreed price;
from 1 week before the start of the contract 80% of the agreed price;
If you do not show up without notification, 100% of the agreed price.

The agreed price corresponds to the total price listed in the reservation confirmation, which was also sent electronically. The cancellation fees are due upon receipt of the withdrawal.
3. The guesthouse is obliged in good faith to rent unused accommodation to someone else and must offset the fee earned against the cancellation fee claimed by it.
4. The guest reserves the right to prove that the guesthouse suffered no damage or significantly less damage.
Additional costs/damage
1. The accommodation must be handed over in perfect condition upon departure. The guest must ensure that all items, the accommodation itself and all products provided by the guesthouse are left in perfect condition. This applies in particular to furnishings (furniture, mirrors, TV, etc.), the apartment/room itself (floors, walls, tiles, lamps, etc.) and all items used that are under the responsibility of the guesthouse. All items provided by the guesthouse (e.g. electrical appliances, hand and bath towels, etc.) also fall under this clause.
2. If, in addition to the standard services offered and provided by the guesthouse, additional expenses are incurred which are caused by the guest (e.g. increased cleaning performance due to increased dirt, inappropriate use of materials such as towels, toilet paper, etc.), these will be invoiced to the guest provided. The basis for calculating these services/materials is the supplier's price lists (such as bed linen/towels) as well as the comparison to the traditionally provided service. In the event of extreme contamination such as feces etc., the guesthouse reserves the right to commission a cleaning company and to charge the full amount for this.
Termination by the pension
The guesthouse is entitled to terminate accommodation contracts with immediate effect and to expel the guest from the house in the exercise of his house rights if the guest damages the reputation, safety or reputation of the guesthouse, is suspected of committing criminal offenses or other guests, residents, Harasses, repeatedly disturbs or endangers passers-by or neighbors.
In particular, repeated violations by the guest of the provisions of these General Terms and Conditions or the house rules posted in the house, as well as damage, soiling or theft of property, entitle the guesthouse to terminate the contract immediately. This also applies if the guest uses the room or other rooms in the guesthouse for a purpose other than that agreed upon. In these cases, the guest may be obliged to pay compensation and pay for the accommodation that has already been used, as well as to pay for the accommodation that has not yet been used in accordance with the cancellation regulations.
care
1. The accommodation may only be occupied by the number of people specified in the contract. Deviations from this require a prior written agreement with the guesthouse. The stated maximum number of people also includes children. In the event of overcrowding, the guesthouse is entitled to demand additional appropriate compensation for the period of overcrowding. The excess people must leave the accommodation immediately.
2. The guesthouse is not liable for loss or damage caused by items brought in, including cars. Bringing your own property into the accommodation, including parking your car in the parking lot, is at your own risk.
3. Claims for damages
The guest is obliged to handle the guesthouse's inventory carefully. If the guest behaves in breach of contract, such as smoking or intentionally damaging the furnishings, the hotelier can exercise his extraordinary right of termination. All resulting costs and follow-up costs must be borne in full by the person responsible.
6. A pet may only be brought with you after prior agreement with the guesthouse. This must be displayed in the reservation. The guest bringing them in is solely liable for any damage caused by pets.
Place of jurisdiction
The exclusive place of jurisdiction is the Potsdam District Court
Final provisions
If individual provisions of these General Terms and Conditions for concluding accommodation contracts are invalid, this will not affect the validity of the remaining provisions. Instead of the invalid provision, one of the legal provisions that comes as close as possible applies. Any deviation or additional agreement must be in writing.
